Court of Appeals Rules in Favor of Teva on Biaxin(R) XL Preliminary Injunction

JERUSALEM--(HSMN NewsFeed)--June 22, 2006--Teva Pharmaceutical Industries Ltd. (Nasdaq: TEVA ) announced today that the United States Court of Appeals for the Federal Circuit has vacated a June 2005 ruling by the U.S. District Court for the Northern District of Illinois, which had granted Abbott's motion for a preliminary injunction related to Teva's generic Biaxin® (Clarithromycin) XL Filmtabs®.



Teva's Abbreviated New Drug Application (ANDA) for the antibiotic Clarithromycin Extended Release Tablets, 500 mg has already been granted final approval by the U.S. Food and Drug Administration. Annual brand product sales in the U.S. were approximately $255 million for the twelve months ended March 2006, based on IMS data.

Teva is currently involved in patent litigation with Abbott concerning this product. A bench trial has been scheduled for March 2007.
