IMPAX Announces Dismissal of Lawsuit Related to Generic Concerta(R)

HAYWARD, Calif.--(HSMN NewsFeed)--IMPAX Laboratories, Inc. (OTC:IPXL ) today announced that it and ALZA Corporation and McNeil-PPC have filed with the court a signed stipulation for the dismissal of a patent infringement lawsuit related to the Company's Abbreviated New Drug Application (ANDA) for methylphenidate hydrocholoride ER, 18, 27, 36, 54 mg. tablets, generic of Concerta®. Alza Corporation and McNeil-PPC filed the suit against the Company last year in United States District Court for the District of Delaware. The Company's ANDA remains under review by FDA as well as a Citizen's Petition filed by McNeil relating to approval criteria for Concerta generics.

Concerta is marketed by McNeil Consumer & Specialty Pharmaceuticals, a division of Johnson & Johnson, as a once-daily treatment for attention deficit disorder/attention deficit hyperactivity disorder. According to Wolters Kluwer Health, U.S. sales of Concerta tablets were approximately $846 million in the 12 months ended July 2006.
