German Court Finds Edwards Lifesciences' Transcatheter Valve Patent Not Infringed by CoreValve
Company Plans Prompt AppealIRVINE, CA--(Healthcare Sales & Marketing Network)--Oct 16, 2008 -- Edwards Lifesciences Corporation (NYSE:EW ), the world leader in the science of heart valves, announced today that the District Court of Düsseldorf, Germany, has rejected its assertion that CoreValve, Inc., is infringing Edwards' German patent for its transcatheter heart valve technology. The company remains convinced that CoreValve's product infringes Edwards' intellectual property and will promptly appeal this decision. The ruling has no effect on sales of the Edwards SAPIEN transcatheter heart valve in Germany or anywhere else.
"While we are disappointed by this initial court decision, defending our intellectual property is only one element of our broader leadership strategy," said Larry L. Wood, Edwards' corporate vice president, transcatheter valve replacement.
Separately, the Federal Patent Court in Munich, Germany, will rule on the validity of Edwards' Andersen patent in early 2009. Edwards also has lawsuits against CoreValve in the United Kingdom and the United States for infringement of the Andersen family of patents.
